Summary
Twenty states and the District of Columbia currently have medical marijuana laws and six states are slated to join them. Two states have recreational marijuana laws with four states posturing to follow suit. As more and more states legalize the use of marijuana, new over-the-counter businesses are vying for the rights to manufacture and sell it. It may be a matter of time before marijuana sale and consumption may resemble that of alcohol. This is a major change in the U.S. and presents challenges to those who deal with drugged-driving issues. What kind of evidence is prevalent in demonstrating the effects of THC on driving? How is THC detected? Is a "medical marijuana" card an affirmative defense? What type of drug detection technology is on the horizon? What are the other legal issues? After taking this program participants will be able to: Identify important elements in a marijuana impaired driving case; Rule on unique legal issues that arise in these cases; Effectively craft sentences to reduce drugged driving and increase public safety; State the history and current U.S. laws regarding cannabis.
